Also there is information on wine and beer brewing permitting. The TTB allows the making of beer per the1978 Law 95-458 (H.R. 1337), without the payment of tax, for personal use, not for sale. The beer produced per household may not exceed: (1) 200 gallons per calendar year per two adults or 100 gallons per calendar year if only one adult residing in the household.
The TTB controls all distillation and alcolhols permitting for the Feds.
Fun facts on distillation laws: The 1933 Twenty-first Amendment to the US Constitution repealed the Eighteenth Amendment which required Prohibition of all inebriating consumables, starting on on January 17, 1920.
Amendment Twenty-one was the answer after 13 years of Al Capone and NASCAR excitement
Section 1. The eighteenth article of amendment to the Constitution of the United States is hereby repealed, finally!
Section 2. The transportation or importation into any State, Territory, or possession of the United States for delivery or use therein of intoxicating liquors, in violation of the laws thereof, is hereby prohibited, this gives the states control of all aspects of alcoholic beverages, except where Federal law controls.
Following repeal of national prohibition, some states continued prohibition within their borders. Other states left control to local jurisdictions, counties, and cities. The resulting legal landsape is a crazy quilt of dry and wet areas, and a wide difference of ability to own or operate a still.
Remember, distillation of moonshine is illegal without a federal permit and is inherently dangerous because of ethanol’s flammability (never operate a homemade still indoors). For more information on distillation laws, visit the Federal TTB FAQ: http://www.ttb.gov/spirits/faq.shtml
